Questions put concerning the cemetery debate at Waipori - 8th March 2001

    WHY did Murray Burns (Regulatory Services, Clutha District Council) not address the Cemetery Trustee issue when he has admitted that he thought there was only one remaining trustee, while knowing that there had to be a minimum of three?

    WHY did Burns tell Mr Read (owner of the house of the cemetery) that trustee approval was forthcoming and he could proceed with the building when in fact trustees don't have the power to approve building on cemetery reserves?

    WHY did not council not review all cemetery trustees after each election when it is a statutory requirement to do so?

    WHY did the council forward the building consent notice to "Waipori Cemetery Trustees c/- Kelvin Read" when they knew Mr Read was not a trustee?

    WHY were submissions accepted for the reserve revocation process when only objections were advertised for, and how did supporters of revocation know to dubmit submissions, and why did the Mayor tell council that twice the number of submissions were received in support than there actually were?

    WHY did council set a date of 18th December 2000, 9am, for objections and then break their own rules - some accepted 19th December and later?

    WHY did council blatantly violate the Building Act, the Burial and Cremation Act and the Reserves Act in order to support non-ratepayer and non-resident, Kelvin Read?

    WHY is the trustee issue a media issue when that same trustee (G.J.H. Cotton) is trying to get the rule of law upheld and the it is the council who are the law breakers?

    WHY did the council issue a building permit to build, to someone who used the cemetery land description (block and sections numbers)?

    WHY has the council not published the Ombudsman's findings?

    WHY has not this building issue not come before the Lawrence-Tuapeka Community Board before proceeding further?

    WHY did not Councillor Wayman Roughan not stop the building at the framework stage when the trustee (G.J.H. Cotton) told him it was on reserve land?

    WHY hasn't the application that the council at a full meeting approved to proceed, to revoke cemetery status for the house and land, proceeded to the Local Conservator?
